HOW
DO I KNOW IF I HAVE A PERSONAL INJURY CASE?
To have a personal injury case
there must be two factors present. First, you must be
able to show that you have suffered an injury. This
can be a physical or an emotional injury. Second, you
must be able to show that someone else (the defendant)
is at fault for your injury either because of negligence,

the other party is more at fault for the injury than

Negligence:
Applies to an injury or accident that could have been
avoided, but the defendant, person or company you have

neck. The department store may be found negligent for
failing to follow certain safety precautions.
Strict Liability: Applies
to an injury caused by manufactured products that are
defective. Examples would include poorly designed cars,
hazardous toys, unsafe power tools, and medicines and
other health care products that cause dangerous side-effects
or death.
Not only is the manufacturer liable for design defects
that cause injury, the merchant or distributor who sold
the defective product can also be held liable in certain
cases.
Intentional Misconduct:
Applies to injuries intentionally caused by another’s
intentional actions as opposed to negligence or carelessness.
Example of an intentional misconduct includes battery
or assault (being hit or being threatened with physical
violence) false imprisonment, invasion of privacy, and
trespass. Also, defamation is usually considered an
intentional misconduct, because the defendant intentionally
prints or speaks the defamatory statement.
